The bids and conditions of fixed salary employees are fixed by the resolution of the Department of Finance 2006. Fixed salary employees appointed by direct recruitment under this policy end their recruitment process during their fixed salary services at another place of the same cadre, upper cadre place or regular pay scale.  When selected, they resign from the existing fixed salary position and get appointed to a new position.

 But sometimes for social reasons.  Geographical conditions as well as other reasons do not suit the newly appointed places.  In these circumstances, it was under active consideration of the State Government to make necessary provisions in this regard as no provisions are currently in force for the return of the employee to his or her original cadre.

 Resolution: Dt.  Fixed salary employees appointed under the policy of 16/02/2006 at the end of the prescribed recruitment process during their fixed salary services at another place in the same cadre.  Preference is given to upper cadre posts or regular pay scale posts.

 Such fixed salary employee resigns from his fixed salary cadre to another post of the same cadre, upper cadre post or regular pay scale post.  It is hereby decided to make the following provisions at the end of the adult consideration regarding re-appointment in the cadre (in the resigned cadre).  Under the policy enacted by the resolution of the Finance Department dated 16/02/2016, an employee appointed on fixed salary resigned from one cadre to another same cadre or upper cadre fixed salary or regular cadre of upper cadre from the service of his previous cadre immediately.  The benefit of returning to service will be for a period of up to 1 (one) year of their new appointment.  Thus a fixed salary employee returning to the original cadre will immediately lose the prominence of his previous original cadre and it will be considered as his new appointment.  And the service of the cadre returning from the previous cadre will not be considered as consecutive service under any circumstances.

 (2) The benefit of this resolution regarding the return of a fixed salary employee to his original cadre shall be available only once during his entire tenure.  The benefit of this resolution will not be available in case the fixed salary employee has been dismissed / terminated for disciplinary reasons in his original cadre or has been dismissed in the new service on disciplinary matters or disciplinary proceedings are pending.

 The employee / officer who makes such a change of fixed salary or returns to the original cadre shall have to recover fifteen (15) days of the total monthly salary of the salary paid after the change of cadre and also the training cost of the trainee.  This resolution shall be implemented from the date of publication of the resolution.  By order of the Governor of Gujarat and in his name,
